Cannock Chase Retired Miners and Officials Association.....The proposals to use CPI as the calculating factor for annual index increases to private pensions....THE COALITION GOVERNMENT HAVE BACKED DOWN !.It has been announced today by the Pensions Minister Steve Webb that he would not force private pension schemes to adopt CPI....This announcement represents a major " U Turn " by them and an equally major victory for those of us who have continually objected against it....The `Stigma `, as far as we can see, is that the Gov`t; will continue to undermine the well - being of our old - age pensioners and any people who receive welfare benefits by paying these annual increases based on CPI....With energy use at it`s maximum and energy prices at their highest, we will say again, - this is cruel and vindictive towards the weakest element of our society....For miners pensions it gives the trustees peace of mind, they can continue paying our pensions using RPI as the calculating factor....This association wishes to give our heartfelt thanks to all of you on this site who supported our campaign on this matter and to the leaders of the NUM who allowed us the space to air our arguments....We also wish to thank the `Moderators ` of the " welshcoalmines " site, who afforded us the same facility....WE NOW ASK !.... Bobby, the NUM website has now been transferred to our own in-house server. There has been some difficulty in this move which we hope have now been resolved.

1982 remember having to knock the icicles off the Bell-wires at top of Bullcliffe Drift. 10 minutes at a time because of chill factor of the air being pulled down the drift by the Mine Main Fan.What would it have been like this winter.

will the NUM organise a pro active campaign to address the pensions issue, by holding a pensions Conference day in the Bansley NUM Hall with all the relevent areas involved with the aim of formulating a campaign committee and action to highlight our arguments,at the moment knowbody knows anything and to my knowledge progress isn't even on the agenda.

Arranging a Pensions Conference in the NUM Offices in Barnsley would not be a problem although forming a campaign committee from attendees would be difficult as it would have no funding to progress the issue without the approval of the NEC/F&GP. There would also be some information that could not be made public at the meeting which may look like nothing is being done. On the issue of our MPS Pensions the reality is that this has been pursued by the National Union of Mineworkers Officials and Executive but it has to be said with little success to date.

The good news is that the Kent Miners Festival - on August Bank Holiday 2011 is is moving to Aylesham for the next 2 years- We will keep you posted. We have also moved the Miner Statue to the former Betteshanger Pit site.

On Twitter last week an image appeared of the Miners Hall up Victoria Road in Barnsley.
Ir referred to a union course being attended.
Is it possible to publish on the website courses that are available to retired members so that we can apply as and when they occur.
Also what benefit are retired members entitled to.
Can I suggest that if a name does not appear in the dialogue box above that the item is not published in future so that students are aware of this, Thanks.

In reference to Mick Westwood - who shafted the miners. Despite trying to re-negotiate the terms of the 1994 Agreement - it has been apparent for some considerable time that the only way forward is to mount a legal challenge.

MINERS PENSIONS, - WHO SHAFTED THE MINERS?.
Lawrence,...I support your call 100%.The National Executive of the NUM should instruct the leadership to seek immediate legal advice on the legality of the 1994 agreement.We want to know why former Nationalised pension funds, like British Telecom, British Rail,British Gas and the National Grid all enjoy a " Free " guarantee, - when we, - the miners, have to give back half of our profits?.... Our leaders should ask the lawyers to establish if this agreement is penalising the miners pension funds by doing this and,given that the BT fund " Guarantee " was ageed in 1984, the lawyers should also be asking if that agreement did set a precedent for all other former Nationalised pension funds to follow.?....Our pension funds trustees should also be seeking legal advice with a view to pursuing a similar case trough the courts on behalf of the members....It is time now for strong representation from the union and the trustees of the Mineworkers Pension Scheme, in defence of the combined membership....Part of the introduction into this guestbook says that the NUM is: " Representing miners, their families and their communities".... NOW is the time to turn that into a statement of intent.

got letter back today turned down for miners knee ,got 10% they say must have 14%,any ideas what to do next they say i can appeal but what do i need to do different ive told them everything can any one help .cheers

Willi in some claims 10% is not a bad result, when it would add on to other percent's, such as for VWF,CBE or other older injury claims, which would take the percentage over the 14% therefore paying an industrial injury pension.in these cases it would be dangerous to appeal as the appeal tribunal can add to the percent or take it away.
my guess is that you have no other percents.
your options are
1 appeal in which case you will receive the bundle of papers concerning your appeal and you will need to go through the papers to see what the medical adviser said and how the decision maker came to the decision. ( the Scottish area of the NUM have trained up 6 reps to take appeals and it may be worth getting in touch with your area offices to find out if they will take the appeal)
2 do not appeal keep the 10% and put in a claim for any of the following which you may have Vibrating White Finger
Carpal Tunnel Syndrome
Chronic Bronchitis & Emphysema
or any old industrial injury which you may suffered but not claimed through the DWP.
3 do not appeal keep the 10% and if you have no other injuries or disease, and if you Osteoarthritis continues to worsen, in a couple of years put in for a change of circumstances.
without knowing your full work history it is difficult for me to advise.
but I repeat contact your area NUM office for personnel advice

thanks for that advice bobby ,took option number 2,kept my 10% and put in for vwf ,of which had to go for another medical an fortunately today got my reply back got extra 6% and luckily am getting my benefit thanks for your advice mate cheers.

I would imagine that CCT is the NUM's interest as they are not a political party.
However pensions for miners is an issue looking at this from a pressure group point of view in relation to CPI and RPI and issues related to the bonuses generated by the Mineworkers Pension Scheme.

Recent newspaper reports have shown that in 1984 the Tory Government agreed to GUARANTEE the pensions of British Telecom empoloyees, - AT NO PREMIUM, - should the company fail. HOWEVER, - In 1994, - the same Tory Government " Agreed to Guarantee the MINERS PENSIONS - AT A 50% PREMIUM.
WHAT WAS THE DIFFERENCE.? Both were Nationalised Company`s, - WHO SHAFTED THE MINERS.?

Just had an appeal rejected for miners knee after waiting 1 year for the appeal hearing. I was diagnosed as 8% the first examination which took place four months after sending in the documention to claim. On my appeal hearting the appeal judge would not change the percentage so the case was lost.
I feel very agrieved as have had two artificial knee joints for over 30 years and suffer great pain. This was all caused from my life in the Pit
Does anyone know any miner who has been successful in his claim for miners knee as I feel the government are just playing lip service to this new undustrial injury 'so called benefit' for miners ?

Let me tell you this Alex, should you have had successful claims in for previous afflictions such as Vibration White Finger, adn Bronchitis, this will effect your claim. It is known as RPQ recoverable Proportional Quantum, or in plain english a recovery from previous DWP claims. Yes I know of one claim that was successful, and had his previous recovery returned.
DWP claims are subjected to a compensation recovery, and you must prove this was taken as in your case. Given this recovery was taken from any successful claims already by the DWP, it is a unlawfull doublw whammy, and should be contested.
The 8% should have been added to any previous DWP awards, above 14% is a benefit award.
Use your local MP. As for common law this is different, and is yet to be settled [ if at all ] in the courts, nevertheless 8% is compensatable in common law.

Re - Mr Alex Rutterford A14 Claim.
Please contact your NUM representative for the North East for further advice. The advice given by Mr Tom Christopher is (with all due respect) wrong. 'Clawback' does not apply in these circumstances as it it not a Compensation payment. If there were previous DWP assessments awarded for VWF, CB&E Pneumoconiosis etc then the 8% , as Mr Christopher states, would have been aggregated to them and a payment made, without Clawback. Without knowing all the medical history Accidents,Injuries etc no one can advise whether there could be a claim for 'Common Law' and that is why it would be wise to speak to a specialist advisor in your area. There are many misleading comments that are putting men off from claiming for Osteoarthritis of the Knees, which we could do without.
